Terms of Service

These Terms of Service (“Terms”) govern your access to and use of pass.day (the “Service”). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use pass.day.

Operator note: Before production launch, publish the operator’s name (and postal address if required) as the data controller / contracting party. You currently operate as an individual in Tokyo.

1. What pass.day is

pass.day is a one-to-one letter experience: you may pass a short letter from your day so that it can arrive in one stranger's morning. It is intentionally small and quiet.

pass.day is not:

  • A social network
  • A public feed or timeline
  • A messaging app for ongoing private chat
  • A place to publish contact details or solicit meetings

2. Eligibility

You must be at least 16 years old (or the higher digital-consent age in your country) and able to form a binding contract to use the Service. If you use pass.day on behalf of an organisation, you represent that you have authority to accept these Terms for that organisation.

3. Account

  • You sign in with Google OAuth. You are responsible for keeping that account secure.
  • You must provide accurate profile information needed for the Service (for example nickname, city/timezone, and morning hours).
  • You may update your profile in Settings.
  • You may export your data or delete your account at any time in Settings → Danger zone. See our Privacy Policy.

We may suspend or terminate accounts that violate these Terms or that create risk for other users or the Service.

4. The letter experience

4.1 Passing a letter

  • You may pass at most one letter per local calendar day (based on your profile timezone).
  • Once sealed and passed, a letter generally cannot be edited.
  • Letters may include short text and an optional image within product limits.
  • Letters are temporary. Content is wiped or expires after a short operational window as part of normal Service behaviour.

4.2 Receiving a letter

  • During your morning window you may receive at most one letter for that local day.
  • A quiet morning (no letter) can happen and is an intentional part of the product.
  • Receiving a letter does not create a relationship, chat thread, or obligation toward the sender.

4.3 Anonymity and presence

The Service may show limited presence information (for example a nickname and place) with a letter. Do not treat the Service as fully anonymous, and do not attempt to identify, contact, locate, or harass another user outside the product's intended experience.

5. Acceptable use

You agree not to:

  • Post illegal, hateful, harassing, threatening, sexually explicit, or otherwise abusive content
  • Include phone numbers, email addresses, social handles, URLs intended for contact, or other direct contact details in letters
  • Attempt to dox, stalk, scam, or solicit other users
  • Upload malware or content you do not have rights to share
  • Interfere with matching, delivery, security, or other users' access
  • Scrape, bulk-export, or misuse the Service beyond normal personal use
  • Impersonate others or misrepresent your identity in a deceptive way
  • Use the Service for advertising, spam, or commercial solicitation

We may moderate, refuse, expire, or remove content, and may suspend accounts, when we reasonably believe these rules are broken.

6. Your content and licence

You retain ownership of the letters and images you create. To operate pass.day, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and delete that content solely as needed to provide and secure the Service (including one-to-one delivery and expiry/anonymisation).

You represent that you have the rights needed to submit your content and that it does not violate these Terms or applicable law.

7. Our intellectual property

The pass.day name, branding, design, software, and documentation are owned by us or our licensors. These Terms do not grant you any right to copy, modify, or create derivative works from the Service except as needed for ordinary use.

8. Privacy

Our Privacy Policy explains how we collect and process personal data, including GDPR-related rights such as access, export, and erasure. By using the Service, you acknowledge that policy.

9. Third-party services

The Service depends on third parties such as Google (sign-in), Supabase (backend), hosting providers, and optionally email providers. Your use of those services may also be subject to their terms. We are not responsible for third-party services we do not control.

10. Availability and changes

We aim to keep pass.day reliable, but we do not guarantee uninterrupted or error-free availability. Features may change, pause, or end. We may modify these Terms; the “Last updated” date will change when we do. If a change is material, we will provide reasonable notice where practicable. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Letters are user-generated; we do not endorse their content and do not guarantee that every morning will include a letter.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) JPY 5,000.

Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud).

13. Indemnity

Where permitted by law, you will indemnify us against claims, damages, and expenses arising from your content or your breach of these Terms.

14. Termination

You may stop using pass.day and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive (including intellectual property, disclaimers, limitations, and governing law) will survive termination.

15. Governing law and disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules, unless mandatory consumer-protection laws in your country of residence provide otherwise.

Courts in Tokyo, Japan will have non-exclusive jurisdiction, except that consumers in the EEA/UK may bring proceedings in their local courts where required by law.

17. Entire agreement

These Terms, together with the Privacy Policy and any in-product rules we present, are the entire agreement between you and us regarding the Service and supersede prior understandings on that subject. If a provision is found unenforceable, the remaining provisions remain in effect.
